Prenuptial agreements are not automatically legally binding in England and Wales. However, if they are entered into freely by both parties, with full disclosure of financial information, and are deemed fair by the court, they are likely to be upheld.

Can we create a prenuptial agreement after we’re married?
Yes but it has a different name. A prenuptial agreement must be made before marriage or a civil partnership. However, a similar document called a postnuptial agreement can be created after marriage or civil partnership to achieve the same objectives.
What can a prenuptial agreement cover?
A prenup can cover a wide range of financial matters, including property ownership, savings and investments, pensions, debts, inheritance, and business assets. It should record the assets that you have before you marry/ become civil partners and also set out agreements about whether or not spousal maintenance payments will be made.
What happens if we don’t have a prenup and divorce?
If you don’t have a prenuptial agreement, in the event of a dispute your assets will be divided and any income claims considered based on English family law. This can result in significant cost and delay before the issues are resolved.
